The statement reads: WARNING: This product contains nicotine. Nicotine is an addictive chemical. It has to appear on the package, occupying at least 30 percent of each of the two principal display panels. It has to be in a minimum 12 point type in Helvetica bold or Arial bold, black text on a white background or white text on a black background, capitalized and punctuated exactly as specified, and enclosed by a rectangular border.

Read that again in packaging terms. Nearly a third of both of your main faces is spoken for, in high contrast, before you have placed a logo. A design that ignores it and gets corrected late usually needs a larger carton, which means a new die line, new tooling and a delay.

So the process is fixed. Mark the warning area on both principal display panels at final size first. Then place the required product information. Then design in what remains. Brands that work this way produce vape packaging that looks deliberate. Brands that do not produce packaging that looks like a warning label with a logo squeezed beside it.

Products that contain no nicotine, and cannabis derived vape products, sit under different rules. Do not assume the nicotine requirements apply or do not apply without checking your specific product and market.

Beyond the warning

Two other regulatory realities shape vape packaging decisions and are worth knowing before you commit to a design.

New tobacco products require premarket authorization from FDA, through the premarket tobacco product application pathway. That process concerns the product rather than the carton, but it affects packaging timing, because artwork and specifications form part of what is submitted and changing them later is not trivial.

Shipping is restricted too. The Prevent All Cigarette Trafficking Act was amended to cover electronic nicotine delivery systems, which brought registration, reporting and delivery age verification obligations, and restricted carriage through the United States Postal Service. That changes how direct to consumer orders move and therefore what the outer packaging has to withstand.

It will not protect e-liquid from light or heat, which belongs to the bottle or the cartridge.
